1. What warmarket is

warmarket is a listing and matchmaking platform for private trade of firearms, gear, and related accessories between users who have completed identity verification. warmarket connects buyers and sellers; it is not a party to any sale, does not take custody of goods or of the sale proceeds for an item, and does not process the buyer-to-seller payment for the item itself. Buyers and sellers arrange and complete the actual transfer of the item and its purchase price directly with each other, off-platform, subject to all applicable federal, state, and local law (including any required licensed-dealer involvement for firearms transfers). Nothing in these terms creates an agency, partnership, joint venture, or employment relationship between Warmarket and any user.

Warmarket has no obligation to monitor listings or users, and reserves the discretionary right to review, remove, or refuse any listing and to suspend any account, without that right creating any duty to do so.

2. Eligibility and verification

You must be at least 18 years old to create an account. Before listing or bidding, you must complete identity verification through our third-party verification provider. Verification confirms that the government-issued ID presented is valid, that it matches a live selfie, and that the holder is at least 18. Verification does not include a criminal history check, does not determine whether someone is legally eligible to buy or possess a firearm, does not confirm that a listed item exists or is as described, and does not guarantee any transaction. Warmarket is not a party to transactions between users. We use the verified date of birth to confirm you are 18 or older. Listing or bidding in age-restricted firearm and ammunition categories requires that you be at least 21. You remain solely responsible for complying with any stricter age or other legal requirements that apply to a particular item or jurisdiction, including the 21-year threshold for handgun transactions through a licensed dealer. Listings and bids may also be restricted based on your state of residence, per the applicable category's rules. You represent that you are not prohibited by federal or state law from purchasing, possessing, or transferring a firearm, and that you will not use warmarket to acquire an item on behalf of, or for transfer to, anyone who is. warmarket may suspend or reject any account that fails verification or violates these terms.

3. Prohibited conduct

You agree not to:

• List, offer, or attempt to acquire any item you're not legally permitted to sell, transfer, or possess, or complete a transaction outside the legal process your jurisdiction requires (including required licensed-dealer transfers);
• Act as a straw purchaser, or use warmarket to acquire an item for someone who could not lawfully acquire it directly;
• Misrepresent an item's condition, legality, or your identity;
• Circumvent, disable, or attempt to bypass identity verification, state-restriction checks, or fees;
• Engage in the business of dealing in firearms without the required federal firearms license;
• Use the platform for any export, shipment, or transfer that would violate U.S. export control or sanctions law, including the International Traffic in Arms Regulations (ITAR), the Export Administration Regulations (EAR), and sanctions administered by the Office of Foreign Assets Control (OFAC). Firearms, ammunition, and many related articles generally may not be exported or transferred to non-U.S. persons without the required licenses; or
• Harass another user, scrape or misuse the platform, or interfere with its normal operation.

Violating this section may result in listing removal, account suspension, forfeiture of fees, and — where the conduct is unlawful — a report to the relevant authorities.

4. Your listing content

You're responsible for the accuracy of your listings and for complying with all laws governing the sale, transfer, and possession of anything you list. By posting a listing, you grant warmarket a non-exclusive, royalty-free license to host, display, and resize the text and images you submit, solely to operate and promote the marketplace. You must own the rights to any photo or content you upload. If you believe a listing infringes your intellectual property, contact us at the address below with the listing URL and a description of the material; we'll review and remove infringing content. State-restricted categories are maintained as a living schedule in the category and state-restriction tables on the platform; updates to that schedule are not amendments to these terms.

5. Fees and billing

Browsing and bidding are free. warmarket does not charge listing, relisting, reserve, transfer, or upgrade fees, and does not charge buyers a service fee. Through January 2, 2027, final value fees, the Dealer plan subscription, and the Collection Sale fee are waived. Beginning January 2, 2027, completed sales are subject to a final value fee of 4% for private sellers and 2.5% for sellers on the Dealer plan or during a Collection Sale, with a $1 minimum and a $250 maximum per sale. The Dealer plan is $49 per month or $490 per year and is available to verified FFL dealers and registered businesses. A Collection Sale is $49 one-time for a 90-day bulk-listing window, once per 12 months. Card processing, if Warmarket runs checkout, is passed through to the seller at cost. Current rates are also published on the fee schedule. All fees are for use of the platform, not for the item being sold. Payments to warmarket are processed by a third-party payment processor; by using paid features you also agree to that processor's own terms of service.

Dealers who activate the Dealer plan on or before January 2, 2027 keep the published Dealer plan rate in effect on that date ($49 per month or $490 per year plus 2.5%) through January 2, 2028. After January 2, 2028, the then-current published rates apply.

The Dealer plan renews automatically at the then-current published rate (or the founding locked rate, while that lock is in effect) until you cancel. You must give separate affirmative consent to those renewal terms before checkout. You can cancel at any time from Account → Billing; cancellation takes effect at the end of the current billing period. Warmarket will send a conversion notice before January 2, 2027 (first notice on or about December 10, 2026, and a final reminder no later than December 26, 2026) stating the date, the amount, and how to cancel in one click. After that, Warmarket will send an annual reminder in the signup medium stating the product, amount, frequency, and how to cancel. Consent records (text, version, timestamp, and IP) are retained for at least three years or one year after the subscription ends, whichever is longer.

A Collection Sale is available to identity-verified individuals once per 12 months for a 90-day window. Before it opens, the seller must attest that the items come from a personal collection or estate and were not bought for resale, and, for an estate, that they have authority to sell. Firearms still transfer through a licensed dealer where required.

6. User-to-user transactions

A listing, bid, buy-it-now, auction close, in-chat handshake, agreed price, message, or any other communication on the platform is solely between you and the other user. It does not make warmarket a party to the deal, a broker, an escrow agent, an insurer, or a guarantor that the deal will complete or that the item is as described.

You are solely responsible for evaluating the other party and the item, arranging payment and transfer off-platform, and complying with all federal, state, and local laws that apply to that transaction, including transfer, shipping, possession, and age requirements, and any required licensed-dealer transfer. warmarket does not inspect items, verify that a listing is accurate, hold funds or goods, complete transfers, mediate disputes, or recover money or property on anyone's behalf.

You acknowledge that deals may fall through or not be as you expected, including because a buyer does not pay, a seller does not ship or transfer the item, an item differs from its listing (condition, authenticity, completeness, title, or legality), a licensed dealer declines a transfer, an auction winner or seller does not follow through, or either party otherwise fails to perform. Those risks are yours. Any dispute, refund, chargeback, or recovery of an item or its purchase price is solely between the users involved.

Fees you pay warmarket — including subscriptions and final-value fees — are for access to the platform, not for a completed sale. Except where required by law, those fees are not refunded if a deal between users falls through, is cancelled, or is not as expected.

7. Suspension and termination

warmarket may suspend or terminate your account, with or without notice, for violating these terms, failing verification, or where we reasonably believe your use of the platform poses a legal or operational risk. You may stop using warmarket and request account deletion at any time. Sections of these terms that by their nature should survive termination (including Sections 3, 4, 6, 10, 11, and 12) continue to apply after your account is closed.

8. Firearms transfers

Firearm transactions must comply with the Gun Control Act and all applicable state law. Unlicensed persons cannot acquire handguns directly from out-of-state sellers; the transfer must run through a federal firearms licensee (FFL) in the buyer's state. Long guns may move interstate only in person, through an FFL with a background check, or in compliance with both states' laws. Through an FFL, the federal age floor is 21 for handguns and 18 for long guns; Warmarket requires you to be 21 to list or bid in age-restricted firearm and ammunition categories. A $0 NFA transfer tax is not deregulation: registration, fingerprints, photographs, a background check, and FFL/SOT transfer still apply where required, and some states prohibit suppressors and other NFA items.

9. Auctions

A bid is a binding offer to buy the listed item at that price if you are the winning bidder when the auction ends and any reserve is met. Proxy bidding places bids on your behalf up to the maximum you set, in the listing's increment. A reserve, if the seller set one, is not disclosed as a dollar amount; the auction does not produce a sale unless the reserve is met. A seller may cancel an auction listing only while it has no bids. A winning bidder who does not follow through, or a seller who does not complete a reserve-met sale, may have listings removed and the account suspended.

10. No warranty; limitation of liability

warmarket is provided "as is," without warranties of any kind, including any warranty that a listing is accurate, that a user will perform, or that any deal will complete. We don't inspect, endorse, or guarantee any listing, seller, buyer, item, handshake, bid, or off-platform transfer, and we don't guarantee that any transaction between users will complete, be lawful, or match either party's expectations.

To the fullest extent permitted by law, you release warmarket and its officers, employees, and agents from, and they are not liable for, any claim, loss, or damage arising from a transaction or attempted transaction between users — including a deal that falls through, an item that is not as described or expected, failed payment, failed or declined transfer, or a dispute between users — or for any indirect, incidental, special, punitive, or consequential damages. Our total liability for any claim arising from your use of warmarket will not exceed the fees you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold warmarket harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your listings, your transactions with other users, your violation of these terms, or your violation of any law.

12. Dispute resolution; governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Except for claims that qualify for small-claims court, you and Warmarket agree to resolve disputes arising out of or relating to these terms or the platform by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Warmarket waive any right to a jury trial and to participate in a class, collective, or representative action. A court of competent jurisdiction in Florida may enter judgment on the award. A venue clause does not waive Warmarket's right to contest jurisdiction elsewhere.

13. Copyright (DMCA)

If you believe content on Warmarket infringes your copyright, send a notice to our designated agent at info@warmarket.com with the information required by 17 U.S.C. § 512(c)(3), including a description of the work, the listing URL, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature. Warmarket will review and remove infringing material. Repeat infringers may have their accounts terminated.

14. Takedown and appeal

Warmarket may remove a listing or suspend an account under Section 1 without creating a duty to monitor. If your listing is removed or your account is suspended, you may appeal by emailing info@warmarket.com with the listing or account, a brief explanation, and any supporting information. Warmarket will review appeals in its discretion and may restore, modify, or leave the action in place. An appeal is not a hearing and does not create any obligation to reinstate.

15. Changes

We may update these terms from time to time; continued use of warmarket after a change means you accept the updated terms.
