1. What warmarket is

warmarket is a listing and matchmaking platform for private trade of firearms, gear, and related accessories between verified users. warmarket connects buyers and sellers; it is not a party to any sale, does not take custody of goods or of the sale proceeds for an item, and does not process the buyer-to-seller payment for the item itself. Buyers and sellers arrange and complete the actual transfer of the item and its purchase price directly with each other, off-platform, subject to all applicable federal, state, and local law (including any required licensed-dealer involvement for firearms transfers).

2. Eligibility and verification

You must be at least 18 years old to create an account, and 21 or older where a category requires it. Before listing or bidding in age-restricted categories, you must complete identity verification through our third-party verification provider. Listings and bids may be restricted based on your state of residence, per the applicable category's rules. You represent that you are not prohibited by federal or state law from purchasing, possessing, or transferring a firearm, and that you will not use warmarket to acquire an item on behalf of, or for transfer to, anyone who is. warmarket may suspend or reject any account that fails verification or violates these terms.

3. Prohibited conduct

You agree not to:

• List, offer, or attempt to acquire any item you're not legally permitted to sell, transfer, or possess, or complete a transaction outside the legal process your jurisdiction requires (including required licensed-dealer transfers);
• Act as a straw purchaser, or use warmarket to acquire an item for someone who could not lawfully acquire it directly;
• Misrepresent an item's condition, legality, or your identity;
• Circumvent, disable, or attempt to bypass identity verification, state-restriction checks, or fees;
• Use the platform for any export, shipment, or transfer that would violate U.S. export control law; or
• Harass another user, scrape or misuse the platform, or interfere with its normal operation.

Violating this section may result in listing removal, account suspension, forfeiture of fees, and — where the conduct is unlawful — a report to the relevant authorities.

4. Your listing content

You're responsible for the accuracy of your listings and for complying with all laws governing the sale, transfer, and possession of anything you list. By posting a listing, you grant warmarket a non-exclusive, royalty-free license to host, display, and resize the text and images you submit, solely to operate and promote the marketplace. You must own the rights to any photo or content you upload. If you believe a listing infringes your intellectual property, contact us at the address below with the listing URL and a description of the material; we'll review and remove infringing content.

5. Fees and billing

warmarket charges listing fees, subscription fees for paid account tiers, and — for auctions — a final value fee charged to the seller once an auction closes with a winning bid, calculated as a percentage of the winning bid and billed to the payment method on file. All fees are for use of the platform, not for the item being sold. Payments to warmarket are processed by a third-party payment processor; by using paid features you also agree to that processor's own terms of service.

6. Suspension and termination

warmarket may suspend or terminate your account, with or without notice, for violating these terms, failing verification, or where we reasonably believe your use of the platform poses a legal or safety risk. You may stop using warmarket and request account deletion at any time. Sections of these terms that by their nature should survive termination (including Sections 3, 4, 7, and 8) continue to apply after your account is closed.

7. No warranty; limitation of liability

warmarket is provided "as is," without warranties of any kind. We don't inspect, endorse, or guarantee any listing, seller, buyer, or item, and we don't guarantee that any transaction between users will complete lawfully or at all. Disputes over an off-platform transaction are between the buyer and seller. To the fullest extent permitted by law, warmarket and its officers, employees, and agents are not liable for any indirect, incidental, or consequential damages, or for any loss arising from a transaction between users, and our total liability for any claim arising from your use of warmarket will not exceed the fees you paid us in the twelve months before the claim arose.

8. Indemnification

You agree to indemnify and hold warmarket harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your listings, your transactions with other users, your violation of these terms, or your violation of any law.

9. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, and any dispute not otherwise resolved will be brought in the state or federal courts located there.

10. Changes

We may update these terms from time to time; continued use of warmarket after a change means you accept the updated terms.
